Flow Jual Beli Hartanah di Malaysia secara mudahnya seperti berikut khususnya utk second hand (Sub-sale) property.
(1) Booking 2-3% ——–> (2)Sign S&P ———> (3)Apply Consent (Jika Perlu) ——-> (4)Settlement Period (3Bulan + 1bulan) ——> (5)Ambil alih hartanah

(1) Langkah pertama bayar booking. biasanya 2-3% dari price. lawyer akan sediakan dokumen perjanjian jual beli. Resit dan Offer letter akan diberikan.
(2) dalam masa 14 hari atau lebih (lihat letter offer), kedua-dua pihak perlu sign perjanjian jual beli. sekiranya gagal disebabkan buyer, booking dikira hangus. sekiranya penjual menarik diri, pembeli boleh memaksa penjual utk teruskan jualan (rujuk Letter offer: Specific performence). semasa perjanjian jual beli ditandatangani. pembeli perlu membayar baki deposit (biasanya 10%) kepada owner.
(3) dlm kes2 yang perlukan consent diperolehi (cth: leasehold, malayreserce, mastertitle) lawyer akan uruskan utk dptkan consent. selepas consent diperolehi, barulah settlement period dikira.
sekiranya hartanah tersebut tidak memerlukan consent, settlement period dikira dari tarikh perjanjian jual beli.
(4)Pembeli mesti menjelaskan baki harga rumah (biasanya 90%) dalam tempoh 90 hari. sekiranya gagal, pembeli diberi masa 30 hari tambahan dengan faedah dikenakan kepada pembeli yang dikira secara harian. sekiranya gagal (bank tak approve atau gagal dpt pinjaman) maka deposit 10% dikira hangus.
(5) pembeli boleh ambil alih hartanah selepas full settlement dibuat..
